Bartlett, McDonough, Bastone & Monaghan's
area of practice is civil litigation with a major emphasis
in the medical malpractice defense field.
Our attorneys have extensive experience in
representing hospitals, nursing homes and organizations in
health related fields. We have also frequently represented
physicians and other health care providers through their professional
liability insurers. The firm is approved counsel of the New
York State Medical Society insurance program and handles both
general liability and malpractice cases for a number of hospitals
in the metropolitan area. Each of our partners has varied
trial experience; is fully conversant with the health care
field and in many instances is widely known to the professional
and administrative staffs of local health care institutions.
The support staff has been trained to effectively interact
with hospital personnel so as to complement the delivery of
legal services within an integrated claims management program.
Our lawyers are fully familiar with the special handling,
reporting and tactical considerations involved in the representation
of both insured and self-insured hospital clients. Each attorney
is available to answer inquiries, attend case conferences
and discuss fully, any matter assigned to us. Our lawyers
have frequently been called on to assist with regulatory matters
including proceedings before the Office of Professional Medical
Conduct, the Office of Professional Medical Discipline, The
New York State Department of Health and The New York State
Commission on the Quality of Care for the Mentally Disabled.
Our firm consists of attorneys at all levels
of experience, ensuring that the attorney assigned to a particular
case or case event (i.e., conference, trial, witness prep,
etc.) is equal to the task at hand, while at the same time
providing our clients with the lowest cost professional required
by that task. We also make maximum use of paralegals to perform
time-consuming work that may be prudently delegated to them
rather than performed by more costly lawyers.
To further maximize the cost effectiveness
of our representation, we maintain a number of support departments.
Our Deposition, Court Calendar and Motion departments all
perform tasks related to case scheduling in order to assure
that attorney time is not spent on administrative tasks. Finally,
we maintain an in-house trial preparation department, consisting
of trained investigators in order to minimize the cost of
witness location, service of papers and trial assistance.
